Family Medical Leave Act -- Too Baby-sit
Question:
One of our employees takes intermittent Family Medical Leave to take their autistic child to the doctor. However, the other day they asked for Family Medical Leave to watch this same autistic child because the baby sitter did not show. Does FMLA cover problems with baby sitting?
Answer:
The Family Medical Leave regulations state that coverage extends to “situations where the employee needs to fill in for others in caring for family members.” Because autism fits the definition of a serious health condition, the employee’s care of that child when the baby sitter does not show would be covered.
