Sharing Records With Union Reps.
Question:
Our Union Steward came into my office and asked me to provide the attendance records of each individual shop employee for the past six months. He indicated he is looking into our disciplinary process. Are we required to give the records to him?
Answer:
The National Labor Relations Board (NLRB) obligates employers to produce requested information to the Union to help them with their investigation, as long as the request is reasonable. The union should be realistic in the length of time you have to go back to produce the information. You are not required to allow them to do the research on company time, nor are you required to make copies of the information. However, it is important that you show a ‘good faith’ effort in complying with the request.
